These Terms of Service (the “Terms”) govern access to and use of the Umola platform, including the World Studio and the Sketch/Game Studio (together, the “Service”). By creating an account, or by otherwise accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use the Service.
1.Introduction and Acceptance of Terms
Umola is developed and operated by Anubhav Kalita, founder of umola.app, trading as Umola (referred to in these Terms as “Umola,” “,” “we,” “us,” or “our”). References to “you” or “User” mean the individual or entity accessing or using the Service.
These Terms constitute a binding legal agreement between you and Umola. They apply to all users of the Service, including registered account holders and, where permitted, unregistered visitors.
Content published on the Service by other users is created and controlled by those users, not by Umola. Umola functions as a hosting intermediary with respect to such content and does not review it prior to publication.
2.Definitions
“Service” means the Umola platform, including the World Studio, the Sketch/Game Studio, associated websites, and related infrastructure made available by Umola.
“Content” means any sketches, three-dimensional worlds, games, characters, thumbnails, titles, descriptions, behaviour scripts, or other material created, uploaded, or generated using the Service.
“User Content” means Content that you create, upload, or cause to be generated through your use of the Service.
“AI-Generated Content” means Content, or portions of Content, produced by an artificial intelligence model in response to instructions, images, or other input you provide.
“Export Credits” means the unit described in Section 11, used to pay for exporting a playable build of User Content.
“AI Tokens” means the unit described in Section 12, used to pay for AI-assisted generation within the Service.
“Personal Data” has the meaning given in the Privacy Policy.
3.Eligibility and Minors
You must be capable of forming a binding contract under applicable law to use the Service. The Service is intended for users who are at least the age of digital consent applicable in their jurisdiction, which is 16 in some jurisdictions, 13 in others, and up to 18 in others.
Users under the age of 18 (or the age of legal majority in their jurisdiction, if higher) may use the Service only with the involvement, supervision, and consent of a parent or legal guardian. The parent or legal guardian agrees to be bound by these Terms on the minor’s behalf and assumes responsibility for the minor’s use of the Service, including any purchases made through the account.
Umola does not knowingly collect Personal Data from a user below the minimum age applicable in that user’s jurisdiction without appropriate parental or guardian consent. Where Umola becomes aware that an account belongs to such a user without such consent, Umola will close the account and delete the associated data, consistent with Section 14 of the Privacy Policy.
You may not use the Service if you have previously been removed from it for violating these Terms, or if you are prohibited from using the Service under applicable law.
4.Accounts
An account may be created using an email address and password, or through a supported third-party identity provider. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify Umola promptly of any unauthorized use of your account.
You choose a username at registration. Your username, together with your profile information, is publicly visible and is displayed on any Content you publish.
Each individual may maintain one account. Creating additional accounts to circumvent a limit, a suspension, a fee, or a promotional allowance is a violation of these Terms.
5.Description of the Service
The Service provides tools that allow a user to:
- Create a two-dimensional sketch and generate a playable browser-based game from it; build a three-dimensional world and generate behaviours, rules, and interface elements for it; create characters and avatars; save, publish, and browse User Content published by other users; and export a playable build of User Content, a paid feature described in Section 11.
The Service is under active development. Umola may add, modify, or discontinue features at its discretion. Nothing in these Terms guarantees the continued availability of any particular feature.
6.AI-Generated Content
Certain features of the Service transmit your instructions, sketches, world data, and associated images to third-party artificial intelligence providers, which generate code and content in response. The providers currently used are Google (Gemini) and OpenRouter. Umola may add or change providers from time to time.
AI-Generated Content is provided without warranty of any kind. It may be inaccurate, non-functional, or unsuitable for your intended purpose. Because generative models are non-deterministic and may produce similar output for similar input, AI-Generated Content may resemble content generated for other users. You are solely responsible for reviewing AI-Generated Content before publishing or relying on it.
As between you and Umola, Umola does not claim ownership of AI-Generated Content produced in response to your input. Umola makes no representation that AI-Generated Content is free of third-party intellectual property rights, and no warranty that it may be used for any particular purpose in any particular jurisdiction. If the provenance or clearance of AI-Generated Content is material to your use of it, you should seek your own advice.
Umola may subject images and other input to automated screening, including by an AI classifier, before storage or publication. Content flagged by such screening as indeterminate may be held pending manual review.
7.User Content
You retain all ownership rights in User Content, including User Content that incorporates AI-Generated Content, subject to Section 6. Nothing in these Terms transfers ownership of User Content to Umola.
You grant Umola a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, adapt in technical format, and transmit User Content for the purpose of operating and providing the Service to you. If you publish User Content, this licence extends to publicly displaying it, including it in listings and search results, and generating preview images of it.
This licence continues for as long as the User Content remains on the Service and for a reasonable period thereafter to the extent copies persist in routine backups. The licence terminates upon deletion of the User Content, except to the extent retention is required by law or by routine backup cycles.
You represent and warrant that you own or otherwise have the necessary rights in all User Content you upload, and that such User Content does not infringe the intellectual property, privacy, or other rights of any third party.
8.Publishing and Public Availability
Publication of User Content is at your election, on a per-item basis. Once published, User Content, together with its title, description, thumbnail, your username, and your public profile, is accessible to any visitor to the Service, whether or not registered.
Published games execute in the client’s browser, meaning the underlying code is technically accessible to any user of the published game. You should not include credentials, personal data, or other sensitive material in published Content.
You may unpublish User Content at any time. Unpublishing removes the item from public listings but does not affect copies already accessed, downloaded, or exported by other users prior to unpublication.
9.Acceptable Use
You must not use the Service to create, upload, or publish Content that:
- i. Depicts or sexualizes a minor in any form;
- ii. Is sexually explicit, or depicts gratuitous violence or cruelty;
- iii. Harasses, threatens, defames, or impersonates any person;
- iv. Promotes terrorism, violent extremism, or hatred against a group or individual.
- v. Infringes the intellectual property rights of any third party;
- vi. Is unlawful under applicable law in your jurisdiction or the jurisdiction of your intended audience; or
- vii. Contains malware, exploit code, or is designed to compromise the security of a user’s device or data.
You must not:
- Circumvent any usage limit, fee, or payment mechanism, including through the use of multiple accounts;
- use the Service’s AI features to automate, script, or bulk-generate requests, or use the Service as a general-purpose interface to a third-party AI provider;
- probe, scan, or interfere with the Service or the accounts or data of other users; or
- resell, sublicense, or otherwise provide third-party access to the Service.
10.Content Moderation
Umola does not review Content prior to publication but may take action following its own review or a third-party report. Umola may, at its discretion:
- restrict Content, making it visible only to its creator, a measure Umola applies preferentially where it is a proportionate response;
- remove specific elements of Content, such as a thumbnail found to violate these Terms;
- permanently delete Content; or
- suspend or terminate an account, as described in Section 20.
Where reasonably practicable, Umola will notify the affected user of the action taken and the reason for it. A user who disputes a moderation decision may contact Umola using the details in Section 24.
11.Export Credits
Exporting a playable build of User Content is a paid feature. One Export Credit is consumed per export. Export Credits are sold in fixed-quantity packs at prices displayed at the point of purchase.
Export Credits are a licence to use a specific feature of the Service. They do not constitute currency, are not redeemable for cash, and cannot be transferred between accounts or exchanged for AI Tokens. Export Credits do not expire on a fixed date but are forfeited upon closure of the associated account, except as provided in Section 20.
Where an export fails due to a fault attributable to Umola, Umola will not knowingly charge an Export Credit for that attempt and will restore one if charged in error.
12.AI Tokens and Third-Party API Keys
Generation of Content using the Service’s integrated AI features consumes AI Tokens. AI Tokens are distinct from Export Credits: AI Tokens pay for generation, Export Credits pay for export, and the two are not interchangeable. New accounts receive an initial allocation of AI Tokens.
The number of AI Tokens consumed by a given generation reflects the computational cost of that generation, including the volume of data and images submitted and the length of the response produced. This amount is determined server-side based on usage reported by the applicable AI provider and is not a fixed price per request.
A generation that fails, times out, or produces output that cannot be used within the Service is not charged. A generation that completes successfully is charged, irrespective of whether the output meets the user’s expectations.
Umola applies rate and volume limits to AI generation to maintain the availability of the Service to all users, and may suspend AI generation platform-wide in response to abnormal demand. Like Export Credits, AI Tokens have no cash value, are non-transferable, and are forfeited upon closure of the associated account, except as provided in Section 20.
Bring Your Own API Key. A user may configure the Service to use the user’s own Gemini API key in place of Umola’s. Where configured, the key is encrypted client-side and transmitted to Umola’s servers only to execute the specific request initiated by the user; Umola does not store the key. This encryption protects against inspection of locally stored data but does not protect against malicious code executing within the Service’s own web page. Generation performed using a user-supplied key is billed by the applicable third-party provider directly to the user under that user’s agreement with the provider, does not consume AI Tokens, and remains subject to Umola’s rate limits.
13.Fees, Payment, and Refunds
Payments for Export Credits and AI Tokens are processed by a third-party payment processor. Umola does not receive or store payment card details. Prices are displayed in the currency shown at checkout and are inclusive of applicable taxes unless stated otherwise.
Export Credits and AI Tokens are credited to an account upon confirmation of payment by the payment processor. If payment is confirmed but the corresponding credit or token allocation does not appear, the user should contact Umola with the payment reference for resolution.
Because Export Credits and AI Tokens are digital goods usable immediately upon delivery, purchases are generally non-refundable once the corresponding credit or token has been consumed. Umola will refund an unused purchase where the transaction was duplicated in error, was not authorized by the account holder, arises from Umola’s own fault, or falls within Section 3 (minors). Other refund requests will be considered on their individual merits. Nothing in this Section limits any statutory right a consumer may have under applicable law, including consumer protection legislation in the user’s jurisdiction.
Umola may change prices prospectively. A price change does not affect Export Credits or AI Tokens already purchased.
14.Third-Party Services
The Service relies on third-party infrastructure and service providers, including for account and data storage, payment processing, and AI generation, as further described in the Privacy Policy. Your use of the Service necessarily involves these third parties, and their own terms of service apply to the portion of the Service they provide.
15.Umola Intellectual Property
The Service itself, including its software, the World Studio and Sketch/Game Studio editors, the underlying runtime engine, and associated trademarks and branding, is the property of Umola and its licensors. Except for the limited right to use the Service as contemplated by these Terms, nothing in these Terms grants you any right, title, or interest in Umola’s intellectual property.
A build exported under Section 11 incorporates a copy of Umola’s runtime engine. You may use, host, and distribute that build as part of your own game. You may not extract the engine for use independently of the exported build or as a component of another product.
16.Intellectual Property Complaints
If you believe that Content on the Service infringes your intellectual property rights, you may submit a notice to support@umola.app containing:
- identification of the work you claim is infringed and evidence of your ownership;
- a link to, or other identification of, the allegedly infringing Content;
- a description of the alleged infringement;
- your contact information; and
- a statement, made in good faith, that the use complained of is not authorized and that the information in the notice is accurate.
Umola will review valid notices and, where appropriate, remove or disable access to the identified Content and notify the affected user. Umola may terminate the accounts of users found to have repeatedly infringed third-party intellectual property rights. Where applicable, this procedure operates alongside, and does not displace, statutory notice-and-takedown procedures such as the U.S. Digital Millennium Copyright Act.
17.Disclaimers
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, UMOLA DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE, ORIGINAL, OR FIT FOR ANY PURPOSE.
Content published by other users is created by those users. Umola does not endorse, and is not responsible for, User Content it did not create.
18.Limitation of Liability
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud.
SUBJECT TO THE FOREGOING, TO THE MAXIMUM EXTENT PERMITTED BY LAW, UMOLA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM OR RELATING TO YOUR USE OF THE SERVICE. UMOLA’S AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THE SERVICE IN ANY TWELVE-MONTH PERIOD SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO UMOLA IN THAT PERIOD, OR (B) FIFTY U.S. DOLLARS (OR THE EQUIVALENT IN LOCAL CURRENCY).
If you are a consumer under applicable law, this Section does not affect any statutory right that cannot lawfully be limited.
19.Indemnification
You agree to indemnify and hold Umola harmless from any claim, demand, loss, or expense, including reasonable legal fees, arising from (a) User Content you create, upload, or publish; (b) your breach of these Terms; or (c) your violation of applicable law. Umola will provide prompt notice of any such claim and will not settle it without your consent, such consent not to be unreasonably withheld.
20.Term and Termination
You may stop using the Service and request deletion of your account at any time by contacting Umola using the details in Section 24. Upon deletion, Umola will remove your account and User Content from the Service, other than data Umola is required to retain by law or that persists briefly in routine backups.
Umola may suspend or terminate an account that violates these Terms, where required by law, or where continued access would expose Umola or other users to material risk. Where reasonably practicable, Umola will provide notice and an opportunity to cure before suspension or termination.
Unused Export Credits and AI Tokens are forfeited upon account closure. Where Umola terminates an account for a reason not attributable to the user’s conduct, Umola will refund any unused Export Credits and AI Tokens purchased by that user.
Sections 7 (to the extent stated), 15, 17, 18, 19, and 21 survive termination of your account.
21.Governing Law and Disputes
These Terms are governed by the laws of India, without regard to its conflict-of-laws principles. Subject to the following sentence, the courts of Guwahati, Assam, India shall have exclusive jurisdiction over any dispute arising from or relating to these Terms. Where you are a consumer and applicable law entitles you to bring proceedings in another forum, this Section does not restrict that right.
22.General Provisions
Entire Agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Umola regarding the Service and supersede any prior agreement on the subject.
Severability. If any provision of these Terms is held unenforceable, the remaining provisions remain in full force and effect.
No Waiver. Umola’s failure to enforce any provision of these Terms is not a waiver of the right to enforce it later.
Assignment. You may not assign these Terms without Umola’s prior written consent. Umola may assign these Terms in connection with a merger, acquisition, or sale of substantially all of its assets.
23.Changes to These Terms
Umola may update these Terms from time to time. Where a change materially affects your rights, Umola will provide notice within the Service or by email before the change takes effect, and will update the date at the top of this document. Continued use of the Service after a change takes effect constitutes acceptance of the revised Terms. If you do not accept a revised version, you should discontinue use of the Service and request account closure under Section 20; Umola will refund unused Export Credits and AI Tokens in that circumstance where the change is one you reasonably object to.
